A Social Security Attorney Review For Disability Applicants Over 50 Years Old
At 50 and over, after you have worked your whole life and suddenly find it especially difficult, the jobs you have spent your life doing are no longer an option, and changing careers can be a real challenge for those over 50 as many employers simply don’t want to invest in training new workers unless they are younger. When you’re over 50, Social Security guidelines recognize that it is harder for you to find alternative work—this is particularly true if your past work history contains only one job. If you are over 50 and are wondering if you qualify for disability, contact one of our Social Security Disability Attorneys. We assist those who are disabled all over the Northwest—For example, if you need a Nampa Social Security Attorney, call as at 208-466-2972.
For Social Security Applicants under 50, Social Security will only find them disabled if they can’t do ANY work. If you’re over 50, you can be found disabled if you can’t do the work you have been doing. This is a huge difference, particularly if the work you have been doing in the past is very physically demanding.
If you are over 50, Social Security Disability looks at what is called your past relevant work to see if you can still do it. If you can, you are not disabled. Past relevant work is the work that you have done full-time in the last 15 years and have done long enough to basically be trained in that position. For example, past relevant work would not include a management position as a nurse’s assistant if you only worked in that position part-time or for just a few months. Social Security will also look at whether the work you have done has helped you learn skills that would allow you to transfer into another job, although that job may be somewhat different from your past work. If can’t perform your past relevant work because of your limitations, but you could transfer your skills into another job that you could perform, you are not disabled.
There are a lot of factors that determine whether you can still do your past relevant work. Good Social Security Attorneys will be able to assist you in evaluating your chances for receiving Social Security benefits. If you are over 50 and have been denied disability or are experiencing issues with your disability benefits claim, contact a social security attorney for a free consultation today by calling 208-344-3044 in Boise or Meridian or 466-2972 in Nampa or Caldwell.
